Terms of Service

These Terms of Service (“Terms”) govern your access to and use of Eter Ava Pro (the “Service”). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

Eter Ava Pro lets you create, train, and deploy an AI assistant (“Eter”) that answers questions from your website visitors, captures leads, and draws on knowledge you provide. AI responses are generated automatically and may contain errors; you are responsible for reviewing content before relying on it.

2. Accounts

You must provide accurate information and keep your credentials secure. You are responsible for all activity under your account. You must be at least 18 years old and able to form a binding contract.

3. Plans, usage wallet & billing

Paid plans are billed in advance on a recurring monthly basis through our payment processor, Stripe. Each plan includes a monthly usage wallet — an allowance of AI usage measured in US dollars. Usage wallets do not roll over between periods and reset at each renewal. You may purchase additional usage (“top-ups”) at any time; top-ups are consumed after your monthly allowance. When a usage wallet is exhausted, website chat continues until your period resets while certain features may pause until you top up or upgrade. Fees are non-refundable except where required by law. You can cancel anytime; cancellation takes effect at the end of the current billing period.

4. Acceptable use

You may not use the Service to: break the law; infringe others’ rights; upload malicious code; send spam; harass or deceive; generate content that is unlawful, hateful, or sexually exploitative; attempt to reverse engineer or overload the Service; or resell the Service without authorization. We may suspend accounts that violate these Terms.

5. Your content and data

You retain ownership of the knowledge, documents, and other content you provide (“Your Content”). You grant us a license to host, process, and use Your Content solely to operate and improve the Service for you, including sending it to AI providers to generate responses. You are responsible for having the rights to the content you upload.

6. AI output disclaimer

The Service uses third-party AI models. Output may be inaccurate, incomplete, or unsuitable for your purpose. It does not constitute professional advice. You are solely responsible for how you use AI output and for any statements your Eter makes to your visitors.

7. Availability

We aim for high availability but do not guarantee the Service will be uninterrupted or error-free. We may modify or discontinue features with reasonable notice.

8. Termination

You may stop using the Service at any time. We may suspend or terminate access for violation of these Terms or to comply with law. On termination, your right to use the Service ends; we may delete your data after a reasonable period.

9. Disclaimers & limitation of liability

The Service is provided “as is” without warranties of any kind. To the maximum extent permitted by law, we are not liable for indirect, incidental, or consequential damages, and our total liability is limited to the amount you paid us in the 12 months before the claim.

10. Changes to these Terms

We may update these Terms. Material changes will be posted here with an updated date. Continued use after changes means you accept the revised Terms.
